A Common Utah Short Sale Negotiation Mistake: Letting Your Ego Get Involved


Salt Lake City, UTAH – What is your final goal? You want to sell your property quickly for top dollar, right? Keep that goal in mind during the entire negotiation.

I have seen people kill a potential sale to a person that would have been willing to pay top dollar for a property because they didn't like the person. Or, the buyer started negotiations with a low ball offer and the seller got offended.

"I refuse to negotiate with someone who insulted me with that lowball offer", they said. And a good buyer moved on to buy another house. Most buyers with lowball offers can be negotiated to a higher price.

Some buyers have a big ego and think they are great negotiators (when they actually aren't.) What is their definition of a great negotiator?

They think that someone with a big ego that tells people off and walks around like they own the world is a good negotiator. They think that being abrasive and rude will get them a better deal. They'll throw around "take it or leave it" offers.

I can tell you from person experience that most buyers are willing to pay more than their "take it or leave it" offer. You just have to keep the negotiations going, even thought you might be a little unhappy or angry with what they are doing.

I have seen home sellers tell off a buyer that said something rude. That buyer could have bought their house. The buyer might actually be a very nice person. Keep your eye on the goal and don't get distracted by petty things.

You want to sell your house for top dollar. Let anything a buyer says that is rude, or otherwise offensive, roll off like water off a duck's back.

A Common Utah Short Sale Negotiation Mistake: Dropping Your Price Before Negotiations Start


Salt Lake City UTAH – Many buyers will ask what your bottom line is. They know that they can usually negotiate a home seller down to an even lower price.

Don't fall for it. You've already made the first move by setting a price for your home. Tell the buyers that you need to think it over and get back to them.

Then, ask them what they like about your home. If they tell you, then you can determine their motivation to buy your home. After that, ask them what they are thinking of offering on your home.

The reason this rule is so important is that in some negotiations you may offer more at the beginning than the other party is willing to accept. Here is an example of this.

A person I know was trying to buy something. He had a price in mind that he was willing to pay. He thought the best price he could get was $1,500, but he was willing to pay up to $2,000.

He asked the seller what he wanted for the item. The seller responded that he didn't know what he wanted. He offered the seller $1,500 and the seller accepted it.

Later on he learned that the seller was desperate. The seller had a price in mind of $800 to $1,000. If the seller had mentioned an opening price first, then he would have saved $500! Instead the seller made an extra $500.

What You Should Know Before Buying A UTAH Short Sale


Salt Lake City, UTAH – If you are considering buying a short sale, then you should know what you are getting involved with.

First off congratulations! Buying a short sale is a great decision. Most short sales usually sell for 3-5% less than other comparable homes.

So you get the advantage of getting a good deal. Now, I am sure you are asking, “Why are short sales a bargain?”

The reason is that a short sale takes longer than a normal real estate sale. You have to wait 30-60 days for the seller’s bank to approve your offer.

In addition, some agents do not understand short sales. They talk bad about them even though they have not educated themselves on how they work.

Here are a few things you should educate yourself on before making an offer on a short sale.

How experienced at short sales is the seller’s agent? If the seller’s agent has little short sale experience, then you should probably look at another house.

How many liens does the seller have? If the seller has three or more mortgages and/or liens, then you should pass. It’s hard to make a short sale work in these situations.

Remember the Aesop’s Fable about the monkeys with their hands in the jar? Well, all three lienholder’s hands are in the cookie jar. But, none will put down any cookies so they can pull their hand out.

The bottom line: One or two mortgages and/or liens is ok. Three or more is not.

Step Three In Fixing The Flawed Bountiful Short Sale Process: Accountability


Bountiful UTAH – Once the lenders have solid data in place to find and measure the problem, then solid decisions can be made to fix the problems. Our last blog post detailed how to get that data.

Once you have the data, then you can have accountability. Here are a few things we know should be held more accountable.

#1: People that value the property for the lenders. Before approving a loan modification or short sale, the lenders compare that financial result with what they can expect from foreclosure.

What they will recoup on the short sale or loan modification is a relatively solid number. What they will recoup on foreclosure is not.

So, they ask an expert to tell them what the property is worth. This person evaluates the property and tells the lender what they think the property is worth.

In our opinion, these valuations are not always accurate. We see many people say a property is worth $240,000. The short sale offer is for $225,000 and is rejected because of the $15,000 difference.

However, when the property is foreclosed and the dust settles, the home ends up selling for $200,000. That is a big discrepancy and someone needs to be held accountable for it.

#2: The people processing these files. In some cases the people processing these files don’t answer calls or respond to e-mails. Because of this, many short sales fail and are foreclosed on later.

If a buyer offering to pay $225,000 walks after two months and the home sells for $200,000 as a foreclosure, then the person processing the short sale needs to be held accountable.

Why A UTAH Short Sale Saves Your Lender Money


Salt Lake City,  UTAH – I throw around the statistic that a short sale reduces a lender's losses by 20% compared to a foreclosure.

However, I am sure that there are many people who find that hard to believe. So today I am going to give you a breakdown of exactly why it happens.

I will use an real life example. A short sale was listed for sale for $425,000. After a few months, the sellers received an offer for $385,000.

They submitted the short sale package to the lender. The lender didn't accept the short sale. The home did not sell as a short sale.

The lender started foreclosure proceedings and foreclosed on the home 19 months later. They put it on the market as a bank owned property (REO.)

It sold for $230,000. This is a real life example. We have lots of other similar examples. Short sale offers are turned down only to have the home sell for much less after foreclosure.

Let's go thru the reasons this lender lost so much money.

First off, the real estate market was declining heavily at the time. Home values are still declining even today. So they lost $155,000 in home value decline. Probably half of that loss was because of the declining market.

The other half was because bank owned homes sell for less than owner occupied homes. Why? Because nothing is maintained. The yard isn't mowed, the house isn't kept clean, and no pride of ownership shows.

Besides, the sales process for bank owned homes also hurts what they sell for. Last of all, buyers know the home is bank owned and make lowball offers because of it.

They also lost interest income. The home would have sold for $385,000 twenty-one months earlier (17 months foreclosure time plus 2 months to put the home on the market and 2 months to sell.)

$385,000 lent at 4.5% interest earns $17,325 annually. Over 21 months that comes out to $30,318.75. Another big loss.

Plus they had to pay property taxes the entire time the home was on the market. Annual property taxes are $6,521.08. Over 21 months that comes out to $11,411.89.

As you can see, the costs just keep on adding up. I'm sure I am missing other costs. Do you see how a short sale benefits a lender?

Another UTAH Short Sale Myth: Lenders Are Dragging Their Feet On Short Sales And Waiting On A Bailout


Salt Lake City, UTAH – I received a question from Josh. Here was his question.

"I heard that a short sale reduces a lender's losses by 20% compared to a foreclosure. You would think that would make them excited to work on my short sale. But, they are dragging their feet.

My lender isn't that excited to work on my short sale. I think they are waiting for another bailout. Do you think that is true? Josh."


Here is the answer to his question and some insight into what is really happening at the lenders. I think at the beginning of the recession the lenders were waiting for a bailout.

But, after that the real slowdown was that they are simply understaffed. In 2007 very few people were short selling their house.

The lenders didn't need a lot of people to process the few short sales. Fast forward 2 years. Short sale volume probably multiplied by ten times or more.

But, it takes time to hire and train more staff. Short sales aren't simple. There are lots of guidelines and laws regulating them. A new staff person can't just show up and start processing files tomorrow.

More than anything else this has slowed down the short sale process. So, do the lenders like short sales? The CEO does because it cuts the lender's losses.

But, the employee who has watched his file law quadruple probably doesn't like short sales. He is having a hard time coping with the extra workload.

UTAH Short Sales: What Do Lenders Consider A Legitimate Hardship For A Short Sale?

Salt Lake City, UTAH – I had a question about FHA short sales yesterday. I did some research on FHA short sales as a result and I stumbled upon something interesting.

I have a list of all of the things that FHA considers legitimate hardships for a short sale. Click here to view the actual list from FHA. The good news is that if FHA considers something a hardship, then it is likely that most lenders agree.

Here is the list of things that FHA thinks are a legitimate hardship for a short sale.
* Death of Principal Mortgagor.
* Illness of Principal Mortgagor.
* Illness of Mortgagor's Family Member. Extraordinary medical expenses are part of the equation.
* Death of Mortgagor's Family Member. Extraordinary expenses are part of the rational.
* Marital Difficulties.
* Reduction in income.
* Excessive Obligations. No loss of income. To quote FHA, "The delinquency is attributable to the mortgagors(s) having incurred excessive debts(either in a single instance or as a matter of habit) that prevent him or her from making payments on both those debts and the mortgage debt."
* Job Transfer.
*Negative Equity Position (under certain circumstances)
* A Problem with the property such as poor quality construction, expensive repairs being needed, etc.
* Inability to Rent Property.
* Military Service where the person can't afford their house because their paycheck won't enable them to cover the payment.
* Unemployment / Job Loss.
* Business failure.
* High Energy Costs. Your income and everything else stays the same, but your utility bill shoots thru the roof. To quote FHA, "All other factors remained the same, but sharp increase in utility cost(s) deferred funds that would have been available for the mortgage payment or costs associated with the removal of environmental hazards in, or near the property."
* Payment Adjustment. To quote FHA, "Delinquency began after either increase in P&I for ARM mortgage or after escrow analysis where one or more escrow item increased, including the spreading of the amount needed to repay an escrow shortage over the next year."
* Incarceration.

Fixing Credit After A Short Sale Step 8: Checking Your Results


Bountiful UTAH – The next step in your credit repair process is a very important one. This is the time where you check the results of your efforts so far.

The credit bureaus have now sent you their results, including a new credit report and a letter telling you what has changed on the report based on your disputes. Don’t just read what they sent and file it away! Make a copy of it, and have it ready to file.

Take out your file that has the original copy of your credit report and put it side by side with the new report.

Take out your copy of the letter you originally sent to the bureau that laid out all the things you were disputing. Go through and compare these disputes against their updated credit report. Their summary might say that an item was investigated but was verified, and so it still shows on your credit report, and wasn’t removed.

They won’t say more than, “item verified.” This could discourage you, but what folks who’ve been down this road before you will tell you is that no one called the original information provider to verify the item – that they used that eOscar dataset to check it out. If they “verified” something on your credit report which clearly isn’t yours:
  1. Call the toll-free number at the top of the report
  2. Tell them your report reference number and ask for “the method of verification per FCRA (Fair Credit Reporting Act) Section 611 (a) (7).
  3. If they say they called the original creditor, ask them for the phone number of the original creditor.
  4. Call the original creditor and ask for the records yourself.
  5. If they say the records are not available, call the credit reporting agency back at their number from the results report and tell them that the original creditor has no records, and that they need to open another dispute – provide them with the name and number of the person you just talked to at the original creditor.
This sounds like a lot of hassle, but it’s worth the extra effort. On the other hand – you might find in your new reporting from the credit bureaus that the disputed item was investigated and the listing was found to be inaccurate or unverifiable! If this is the case, the negative listing will either be deleted from your report all together or it will go from being a negative to being a positive. This is great news for you!

Bountiful Short Sales: Fixing Credit After A Short Sale Step 2: Analyzing Your Credit Report

Bountiful UTAH – Once you have gotten your credit report, the next step in the process of restoring your credit score is to go over it with a critical eye.

Put aside any emotion that looking at the report might stir up – you need to look at it objectively.

First, make two copies of your credit report. Save the original without any marks on it. You can make any notes you need on one of the copies, and put the other copy aside for a later step. Your credit report will show all sorts of history on your credit accounts. Look for all the negative items on your credit report and highlight each one.

The credit reporting firms might not make it easy for you to know what they are considering negative with all the codes they use. As a very general rule, Experian notes negative items with an asterisk or an inquiry; Equifax and TransUnion put “>>>” as a way to signal negative items or items that have a rating higher than l1, M1, or R1. You can also look for these words: repossession, foreclosure, profit and loss write-off, charge-off, paid profit and loss write-off, paid charge off, settled, settled for less than full balance, included in bankruptcy, collection amounts. Paid, unpaid (or anything indicating payment history); court accounts, liens, judgments, bankruptcy (chapters 11,7, or 13) divorce, satisfied liens, or satisfied judgments; or items that show more than 30, 60, or 90 day payments.


All of these should get highlighted by you. Once you’ve highlighted anything that is listed as negative, take out a pencil and put a note next to the items that are either inaccurate or inconsistent. Inaccurate items are the ones that aren’t yours, or show the wrong balance, etc. An inconsistent reporting is where the same information on the report contradicts itself somewhere else. For example, showing one place that there are twelve 31-day-lates on an account, while also saying that the account was only reviewed for 4 months. It is always surprising how often there are errors like that found on credit reports. Remember – there’s a whole lot of information being submitted each day to these companies, and mistakes can happen. The next step will be important to take as soon as you finish highlighting your report. You will need to move quickly through these first few steps – your timing is all tracked and it’s important for you to be diligent so that your credit can be restored.

Bountiful Short Sales: Will I Owe Income Tax After A Short Sale?

Bountiful UTAH – This is one of the first questions potential short sale sellers ask us. “I heard of something called “forgiveness of debt income and that it is taxable. How does that work?” they ask.

The following article is my personal opinion only. I recommend that you consult with a competent legal or tax professional before moving forward with a short sale.

In most cases the answer is that a short sale will usually not cause you to owe income tax.

It used to be that you owed income tax on any forgiveness of debt.

When a lender decides to forgive all or a portion of a borrower’s debt, the forgiven amount is considered as income for the borrower and is liable to be taxed.

Here are the following ways you can qualify to short sale a property without any tax liability.

Short Sale of a Primary Residence. The Mortgage Forgiveness Debt Relief Act of 2007 (and it’s extension in the 2008 Federal Bailout) now allows you to short sale a primary residence without any tax liability.

Today when a homeowner short sales a primary residence, they can file a simple form and the forgiven debt is no longer taxable.

The amount of forgiven mortgage debt allowed to be excluded from income tax is limited to $2 million per year.

Short Sale of a Non-Primary Residence: If the property you are selling is not a primary residence, then you may be eligible for tax relief if you are considered insolvent.

I don’t know the exact guidelines, but insolvent is usually considered when your total gross debts are more than your total gross assets. I’m sure a good tax professional can give you more information.
