UTAH Short Sales: Why do some buyer’s offers get accepted while others are declined?

Salt Lake City, UTAH – I received a question from Jonathan. Here was his question.

"I am looking to buy a short sale. The seller wouldn’t accept my offer. My agent told me it was because the short sale lender has told them they wouldn’t accept the offer.

I am a cash buyer and can’t understand why they wouldn’t take my offer. Why do some buyer’s offers get accepted while others are declined? Jonathan.”

Here is the answer to his question. Usually the offer that is accepted is the one that is offering the highest sales price.

Sure banks and short sale lenders like cash offers. But, that is only everything else is the same. They won’t accept a cash offer when it is lower than other offers on the table.

Here is an example. A normal homeowner is selling their house. It is worth $400,000 and he is asking $400,000 for the home.

A buyer offers $350,000 cash. “You should accept my offer because it is cash”, the buyer says. Meanwhile another buyer offers $400,000 and they have already been approved for a loan.

If you were that seller, what would you do? Would you take a little risk to make an extra $50,000? Most people would. In fact, there isn’t much risk because the buyer has already been approved for a loan.

Yes, cash does matter. But, these banks want to reduce their losses as much as possible. They are already losing tens and hundreds of thousands on a short sale.

They own these homes cash. They don’t have to get their money out right away. They like cash offers, but they like to reduce their losses even more.

Because most short sales are beneficial to a lender. If you accept our offer to help you on a short sale, your lender may not agree to a short sale or to modify your loan. We do offer a loan modification kit.

However, the likelihood of negotiating a modification is like everything else in life. It takes work and persistence to convince your lender to modify your loan. No matter what you or we do, your lender may not approve a loan modification.

We do not recommend that you stop paying your mortgage, because this will cause damage to your credit and could cause you to lose your home. UTAH Short Sales: Why Do Short Sales Fail?

Salt Lake City, UTAH – I recently received a question from James. Here was his question.

"I’ve heard that there is a 70% failure rate on short sales. Is that true? If so, then why do so many short sales fail? James”

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

Here is the answer to his question. Yes, a lot of short sales do fail. However, those statistics are for individual short sale offers submitted to lenders. If the first offer on a short sale is turned down, then another offer is usually submitted.

On each individual house being sold, the failure rate is much lower. Here are the reasons that many short sales do fail.

Reason #1: The sales price is lower than the lender wants. The lender thinks the house is worth X, but the sales price is $30,000 lower than X.

The lenders are not always getting good information on the property values. In my opinion, their valuation method is flawed.

There is a serious conflict of interest in the way lenders obtain their property value. But, the lenders don’t really care to fix it.

Reason #2: The tenant doesn’t want the home to be shown. Many short sales are rental properties. However, the tenant doesn’t want the home to be shown to buyers.

Why not? Well, if the house sells then they will have to move out and find another place. They are comfortable where they are at and they don’t want to move.

This is why a home that is rented is much harder to short sell than a vacant home.

Another UTAH Short Sale Myth: Lenders Are Dragging Their Feet On Short Sales And Waiting On A Bailout

Salt Lake City, UTAH – I received a question from Josh. Here was his question.

"I heard that a short sale reduces a lender's losses by 20% compared to a foreclosure. You would think that would make them excited to work on my short sale. But, they are dragging their feet.

My lender isn't that excited to work on my short sale. I think they are waiting for another bailout. Do you think that is true? Josh."

Here is the answer to his question and some insight into what is really happening at the lenders. I think at the beginning of the recession the lenders were waiting for a bailout.

But, after that the real slowdown was that they are simply understaffed. In 2007 very few people were short selling their house.

The lenders didn't need a lot of people to process the few short sales. Fast forward 2 years. Short sale volume probably multiplied by ten times or more.

But, it takes time to hire and train more staff. Short sales aren't simple. There are lots of guidelines and laws regulating them. A new staff person can't just show up and start processing files tomorrow.

More than anything else this has slowed down the short sale process. So, do the lenders like short sales? The CEO does because it cuts the lender's losses.

But, the employee who has watched his file law quadruple probably doesn't like short sales. He is having a hard time coping with the extra workload.

A Common UTAH Short Sale Myth: Selling My House As A Short Sale Is An Embarrassment

salt Lake City, UTAH – You might think it is an embarrassment to sell your home as a short sale. "My friends will laugh at me when they realize that I owe more on my house than it is worth", some people think.

The reality is that many Americans are in your same position. In fact, some experts think that over a quarter of all homeowners are upside down.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

In fact, this statistic is even worse in areas where the housing market has taken a big drop. You have nothing to be embarrassed of. On the contrary, you should be proud that you are handling your affairs in a responsible manner.

Short Sales usually reduce your lender's losses by 20%. This means you are actually doing your part to help the housing market and economy.

You are doing your part to stop the decline in the housing market. Your neighbor who opts to let their bank foreclose is hurting the housing market.

This is because bank owned properties usually sell for less than a short sale. We have seen this first hand. A Short Sale sells for $400,000 and then a similar bank owned home sells for $300,000.

This is because banks don't maintain the homes they sell and buyers know they can get a bargain.

A Common UTAH Short Sale Case Mistake: Waiting To Long To Submit The Contract To The Short Sale Lender

Salt Lake City, UTAH – Short sales have a reputation for taking a long time. But, they can drag on even longer if the paperwork isn't submitted to the lender in a timely manner.

When the I first started doing short sales, I were hesitant to submit anything to the lender until I had a 100% complete package.

That caused the short sales to drag out a lot longer. After a little while, I learned to submit the paperwork as quickly as possible to the lender.

It usually takes 30 to 60 days for the lender to assign a negotiator to the file. That gives us plenty of time to track down any missing paperwork.

I realized that I were wasting time if I waited 30 days until everything was perfect and then submitted the file. There is a common myth that you shouldn't submit short sale paperwork until it is 100% complete.

Let me explain why that myth just isn't true. A lot of lender have different special forms they wanted filled out specifically for them.

"Oh, you need the buyer and seller to sign the ABC Bank Contract Addendum", the short sale negotiator tells us. Besides, most short sale negotiators want things done certain a way.

Because of this it is almost impossible to put together a 100% perfect short sale file that will have exactly the way the lender wants it. So make sure your agent submits your file quickly and follows up with the short sale negotiator to see if anything is needed.

A Common UTAH Short Sale Case Mistake: Hiring An Agent With Little Short Sale Experience

Salt Lake City, UTAH – A few years ago most agents didn’t understand short sales. They didn’t want to get involved on them because of the extra work required.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

Short sales take two to three times as much work. The extra effort can be draining at times.

Some agents openly admit that they hate short sales. Is that the type of person you want working for you?

Others believe it is wrong for a seller to walk away without a deficiency judgment. “I have heard some agents say that people should be able to walk away from their “obligations.”

Do you think that type of agent is going to push hard for the bank to waive a deficiency? (By the way, that is one of my missions. I want every seller we help to walk away with no deficiency.

We have seen firsthand the stress the banks put on people in foreclosure.) If your agent has no experience with short sales, then they may give up halfway into the process.

So make sure you hire an experienced short sale agent that has successfully closed short sales.

A Common UTAH Short Sale Mistake: Waiting Too Long To Put your Home On The Market

Salt Lake City UTAH – Many homeowners think they have lots of time. “We’ll put out home up for sale in a few months. I know the bank is working to foreclose on it, but we can wait”, they say to themselves.
In order to have a successful short sale, then your agent will need time to submit everything to the lender and for them to process it.

In addition, it can take a month or more for your home to sell. Buyers don’t always materialize in 2-3 days.

If you are less than a month away from a foreclosure sale date, then we can help you. But every day after that makes it harder.

If you are less than a week away from a foreclosure sale, then it is unlikely we can help you. Your lender will have spent months and thousands of dollars on attorneys to get to that point.

They don’t want to waste all that time for nothing. Are you are working on a loan modification, but have short sale as a backup option?

In that case, you can make the short sale process easier by preparing all your documents ahead of time. If you have all of your financial documents prepared, then submitting the short sale will be quick and easy.

That alone will save a lot of time and make the odds of a successful short sale more likely. Thinking about a short sale?

I can help you short sale your property and never pay the bank another penny. Send me an e-mail at forsiecity@gmail.com. I will contact you for a free consultation.

Three Ways To Reduce Your UTAH Short Sale Deficiency

Salt Lake City, UTAH – No one wants a deficiency on a short sale. It’s not your fault the housing market crashed. In fact, some people say that the banks and Wall Street are what caused the crash.

Here are four ways that you can reduce the deficiency amount on your short sale.

1. Negotiate with the lender. Many lenders will settle for substantially less than what they are owed. For example, we have seen lenders settle for as low as 10 cents on the dollar.

In one case, the lender lost over $100,000 on a short sale. They settled with the home owner for a $10,000 promissory note to be repaid over 10 years with zero interest.

Lenders will reduce the amount to settle for over time. They know that the longer they go without being paid, then the less likely it is they will ever be repaid at all. They agree to settle because they know that something is better than nothing.

2. Declare Bankruptcy. If your bankruptcy is approved, then you may be able to have all of the debt erased in a Chapter 7 Bankruptcy.
The problem is that not everyone qualifies for bankruptcy. The bankruptcy laws were changed in 2005 and made it much harder for the average American to qualify for bankruptcy. Talk to a bankruptcy lawyer to see if you qualify. You may not meet the Bankruptcy “Means Test.”

3. Hire a good attorney. Find a good attorney that specializes in defending consumers from collections. Your attorney may be able to find a loophole in the law that makes the debt invalid.

Be careful that you find a lawyer that specializes in this category of the law. You don’t want to pay an attorney to learn on your dime. There are a lot of great lawyers that can help you.

4. Fight the lender’s collections on your own. This is much easier when you genuinely do not have the money to pay. Many people are just scraping by.

Every dime they make is being used towards paying rent, car payments, utilities, and food for your family.

Most states will not allow a creditor to take food out of your mouth.

You can check with a good attorney to find out the laws in your state. There are also legal aid non profits that can give you advice on what to do to stop a garnishment or bank account seizure.

UTAH Short Sale Myth: The bank wants a deficiency on the short sale so I can get out of it by letting them foreclose

SALT LAKE CITY, UTAH – Most people short selling their home do not want to repay the deficiency. And in most cases, the lender allows them to walk away with no deficiency.

But, that is not always the case. Some banks are very pushy when it comes to the deficiency. They won’t approve the short sale unless the borrower accepts a deficiency.

Some home sellers have told the Stop Foreclosure Institute that if the lender won’t approve the short sale without a deficiency, then they will simply allow them to foreclose on the property.

This seems like a good strategy on the surface. But, it could end up costing a homeowner even more money in the long run.

That is because the homeowner loses control over the condition of the home when it is on the market. They aren’t able to maintain the home and keep it up.

Most homes that have been foreclosed on are abandoned by the lenders. Sure, they “winterize” the homes. But, they don’t do anything to keep the homes in tip top showing condition.

This causes most bank owned homes to sell for less money. Here is something else that will cause you home to sell for less money. The buyers aren’t willing to pay as much.

Buyers know when a home for sale is bank owned. What do you think pops into them mind when they see that? “I can buy it for a steal”, they think to themselves.

This causes bank owned homes to sell for less. And if it sells for less money, then the bank will come looking for a larger deficiency payment.

This is why a short sale is usually better for you versus letting the bank foreclose and then sell the house.

UTAH Short Sales: What Do Lenders Consider A Legitimate Hardship For A Short Sale?

Salt Lake City, UTAH – I had a question about FHA short sales yesterday. I did some research on FHA short sales as a result and I stumbled upon something interesting.

I have a list of all of the things that FHA considers legitimate hardships for a short sale. Click here to view the actual list from FHA. The good news is that if FHA considers something a hardship, then it is likely that most lenders agree.

Get my Free, Step By Step Loan Modification Guide by clicking here.

Here is the list of things that FHA thinks are a legitimate hardship for a short sale.
* Death of Principal Mortgagor.
* Illness of Principal Mortgagor.
* Illness of Mortgagor's Family Member. Extraordinary medical expenses are part of the equation.
* Death of Mortgagor's Family Member. Extraordinary expenses are part of the rational.
* Marital Difficulties.
* Reduction in income.
* Excessive Obligations. No loss of income. To quote FHA, "The delinquency is attributable to the mortgagors(s) having incurred excessive debts(either in a single instance or as a matter of habit) that prevent him or her from making payments on both those debts and the mortgage debt."
* Job Transfer.
*Negative Equity Position (under certain circumstances)
* A Problem with the property such as poor quality construction, expensive repairs being needed, etc.
* Inability to Rent Property.
* Military Service where the person can't afford their house because their paycheck won't enable them to cover the payment.
* Unemployment / Job Loss.
* Business failure.
* High Energy Costs. Your income and everything else stays the same, but your utility bill shoots thru the roof. To quote FHA, "All other factors remained the same, but sharp increase in utility cost(s) deferred funds that would have been available for the mortgage payment or costs associated with the removal of environmental hazards in, or near the property."
* Payment Adjustment. To quote FHA, "Delinquency began after either increase in P&I for ARM mortgage or after escrow analysis where one or more escrow item increased, including the spreading of the amount needed to repay an escrow shortage over the next year."
* Incarceration.

Dave Forsberg, Presidio Utah Real Estate - Bountiful, and the Stop Foreclosure Institute are not affiliated in any way, shape, or form with the government. Our services have not been reviewed or endorse by the government or your lender. Most lenders willingly work with agents on short sales. Why?

Because most short sales are beneficial to a lender. If you accept our offer to help you on a short sale, your lender may not agree to a short sale or to modify your loan. We do offer a loan modification kit.

However, the likelihood of negotiating a modification is like everything else in life. It takes work and persistence to convince your lender to modify your loan. No matter what you or we do, your lender may not approve a loan modification.

We do not recommend that you stop paying your mortgage, because this will cause damage to your credit and could cause you to lose your home. Because we know avoiding foreclosure is so important to any homeowner, we recommend that you speak with the appropriate legal or tax advisor before making any decision.

This is not intended as legal, technical, or tax advice. Please speak with a licensed professional before making any decision. Information is deemed reliable but not guaranteed as of the date of writing.

You have the option to reject a short sale or loan modification from your lender if it does not meet your approval. If you decide not to go thru with the short sale, then you do not have to pay us our fee. We normally make a real estate sales commission for helping you on a short sale.

UTAH Short Sale Myth: I Have To Go Thru The Loan Mod Process Before I Can Short Sell

SALT LAKE CITY, UTAH – I recently received a question from Tonia about short sales. Apparently Tonia has been mislead by her lender.

Get my Free, Step By Step Loan Modification Guide by clicking here.

Here is Tonia's question about short sales.
"I've been trying to sell my house for over a year now and have since remarried and moved into my husband's house. I told the realtor I am willing to do a short sale so she called my mortgagor (short sale dept) and they said to just send in the bid. Well, they received a bid but will not accept it. They said it is because I haven't gone through the loan modification process that FHA loans have to go through first before a short sale can be done. I don't want to modify my loan. I want to be dismissed from it. I'm current on my payments because the same guy told me that I could be current and still do a short sale which it isn't sounding like now. Any advise would be great. My house payment is due next week and if it is going to take me not making payments to get this short sale through I won't make them. Tonia."

Here was my response to Tonia.
It sounds like you are being mislead. FHA issues guidelines to lender's that handle their loans. Their guidelines say nothing about a loan modification having to be done first. You can look up the guidelines for FHA Short Sales.

Just google: "Mortgagee Letter 2008-43.

I have read through this countless times and didn't remember a requirement for a loan modification first. I just scanned through it again and didn't see it this time. I do remember we go into this same argument with another short sale negotiator.

They said we had to go through the loan mod process before they could process the short sale. We told them we had read through the entire letter and knew it didn't have that requirement. They backed off and processed the short sale.

You just have to be firm. And if they aren't following FHA's rules, then call up FHA and let them know. FHA may fine them for breaking the rules.

Bountiful Short Sale Myth: If I Sell For More, Then I Won’t Have A Deficiency

Bountiful UTAH – Some sellers think that if they sell their house for more money, then they are less likely to have a deficiency. Let me explain why that is not true.

Get my Free, Step By Step Loan Modification Guide by clicking here.

Another realtor recently told us about a short sale they were involved in. This realtor was representing the buyers purchasing the house. The short sale negotiation company the sellers were using told the sellers that unless the house sold for $295,000, then the sellers would have a short sale deficiency.

Because of this, the sellers wouldn’t accept the buyer’s offer. I told them that couldn’t be true.

Here is how short sale negotiations work.

A lender is losing money on a short sale. In most cases, they are losing a lot of money. Losing just a little bit more money is not going to cause them to change their mind on whether or not they should pursue a deficiency.

A sales price that is $17,000 lower is trivial when compared to a $100,000 loss.

I have negotiated hundreds of short sales. In most cases, the lender is either pursuing a deficiency or not pursuing one. A slightly higher sales price won’t change their mind either way. They will either accept the short sale offer on the table, or counter at a price they will accept.

They will pursue a deficiency even if the property sells for more money.

Fixing Credit After A Short Sale Step 10: Maintaining Good Credit

Bountiful UTAHIf you have a foreclosure or short sale on your credit report, then it will lower your credit score quickly. In the near term, the decrease will be much more than it will be a few months down the road when it starts to inch its way back up.

Get my Free, Step By Step Loan Modification Guide by clicking here.

The credit reporting bureaus weigh the most recent activity more heavily than the distant past. Taking action now to build up the most recent activity is a great way to help your score rebound. So for now, here are the things you should be doing from this day forward to keep your score improving:

First, keep your report clean and clear of NEW negative items. This means that you need to pay on time, every time on open credit. You must not have any new collection accounts or charge offs.

Don’t try to open ANY new credit – this means new car loans, or a Target charge card, or any new opportunity to open any other new credit. Don’t do it. After a foreclosure or a short sale, you want anything that appears on your credit report to be spotless – that the short sale or foreclosure was a blip on the radar, the past, out of the ordinary for you.

Re-build your credit report with favorable credit. Ask your bank if you can use a secured Visa or MasterCard through them. A secured Visa or MasterCard is much like a debit card – you preload it with the amount you want available.

Unlike a debit card, a secured credit card will get reported to the credit bureaus, and this will help to rebuild your score. Obviously, the best way to deal with bad credit scores is to avoid it in the first place if possible.

If you have a history that needs a bit of polishing, hang in there. Follow the steps that I’ve written about, stay on track, you will be able to look back and feel a sense of pride about your accomplishments.

Fixing Credit After A Short Sale Step 9: Rinse & Repeat

Bountiful UTAH – The next step in your path to an improved credit score is to do what they say on the shampoo bottles: Rinse and Repeat.

Get my Free, Step By Step Loan Modification Guide by clicking here.

In the Rinse and Repeat phase, you just keep working their system.

Here’s what I mean: You send in a dispute, maybe disputing the date that the account was opened, and the credit reporting bureau can’t verify it, and they pull the whole listing off your report!

You can’t keep submitting the same dispute reason over and over again to the bureau – they will view you as a nuisance and will dismiss your disputes as frivolous. Also, don’t bombard these folks with your disputes – you won’t get the desired results. But, you can dispute information that needs to be verified.

The suggested order of ways to dispute are:
  1. Not my account
  2. I didn’t pay late that month
  3. That is the wrong amount
  4. That is the wrong account number
  5. That is the wrong original creditor
  6. That is the wrong charge-off date
  7. That is the wrong date for the last activity on the account
  8. That is the wrong balance
  9. That is the wrong credit limit
  10. That is the wrong status of the account
  11. That is the wrong highest amount I owed at any time (High Credit Amount)

You can challenge the same listing on your credit report in the Rinse and Repeat phase. The first time, you might say “not my account” and the next time you would say “I was never late.” You just never know when you’ll find the dispute that gets the listing taken off of your credit report.

Send your dispute in, and let the 30 day clock run. But, like I said before – don’t bombard them immediately after getting your results. Wait 60 days between disputes. Keep excellent records of your efforts.

Be persistent, be insistent, and more than likely it will pay off.

Fixing Credit After A Short Sale Step 8: Checking Your Results

Bountiful UTAH – The next step in your credit repair process is a very important one. This is the time where you check the results of your efforts so far.
Get my Free, Step By Step Loan Modification Guide by clicking here.
The credit bureaus have now sent you their results, including a new credit report and a letter telling you what has changed on the report based on your disputes. Don’t just read what they sent and file it away! Make a copy of it, and have it ready to file.

Take out your file that has the original copy of your credit report and put it side by side with the new report.

Take out your copy of the letter you originally sent to the bureau that laid out all the things you were disputing. Go through and compare these disputes against their updated credit report. Their summary might say that an item was investigated but was verified, and so it still shows on your credit report, and wasn’t removed.

They won’t say more than, “item verified.” This could discourage you, but what folks who’ve been down this road before you will tell you is that no one called the original information provider to verify the item – that they used that eOscar dataset to check it out. If they “verified” something on your credit report which clearly isn’t yours:
  1. Call the toll-free number at the top of the report
  2. Tell them your report reference number and ask for “the method of verification per FCRA (Fair Credit Reporting Act) Section 611 (a) (7).
  3. If they say they called the original creditor, ask them for the phone number of the original creditor.
  4. Call the original creditor and ask for the records yourself.
  5. If they say the records are not available, call the credit reporting agency back at their number from the results report and tell them that the original creditor has no records, and that they need to open another dispute – provide them with the name and number of the person you just talked to at the original creditor.
This sounds like a lot of hassle, but it’s worth the extra effort. On the other hand – you might find in your new reporting from the credit bureaus that the disputed item was investigated and the listing was found to be inaccurate or unverifiable! If this is the case, the negative listing will either be deleted from your report all together or it will go from being a negative to being a positive. This is great news for you!
